6 May Sale by Robert Moore of Clements Inn to Robert Greenwood of Dronfield gentleman, of the timber in various closes in Totley, including all the wood, underwood and trees now standing, growing or being in the two parcels of wood including Gillfield Spring and Long Storth (alias R? Spring)…………together with the root ends… below the surface and all the trees marked RM being 537, or more and also 45 or more wakers or standards at £155 for 1yr 10 months…..in every??? There to be left woodmanlike …….and before 10th of February next entering, fell downe, carry, and convey all trees growing in the ring fence of the Gillfield Spring and (?) for 1yr 10 months term really needs looking at again if particular interest in woods

Know all men by those presents that I Thomas Lord Middleton Lord of the Manor of that part of Totley and Dore that is within the liberties of the Honour of Peverell within the County of Derby - and of the royalty or liberty of free fishing in the river and waters there for divers good causes and considerations and thereto moving HAVE made nominate and appointed and by those presents doe make nominate and appoint Henry Dalton of Totley and Dore aforesaid yeoman to be my true and lawful gamekeeper within or upon the said part of the said manor or lordship of Totley and Dore aforesaid to take care to preserve the game there and does hereby give him full power and authority free liberty and license to hunt, course, sett, hawk, fish, fowl, and kill spare pheasant partridge or any other game whatsoever from time to time and at all times hereafter during my will and pleasure in or upon my said part of the said manor of Totley and Dore and in and upon all and singular the grounds lands woods rivers and waters there of and within all and every the boundaries premits / limits and circuits of the same and further I the said Thomas Lord Middleton doe hereby (as farr as by law I can or may) authorise the said Henry Dalton during my pleasure to take and seize all such guns, bows, greyhounds, setting dogs, lurchers, or other dogs to kill hares or conies ferrets, trammels, hayes or other netts, hare pipes, snares or other engins For the taking of coneys hares pheasants partridge or other game as within the premits? of my said part of the said mannor shall ceased? By any person or persons who by the laws of this realm are prohibited to keep or use the same and the same to be retained and keep for my use and to seize detain and keep to my use all and every nett, angle, leap pike and other engine which he the said Henry Dalton shall find used or layd or in the custody or possession of any person or persons whatsoever fishing or that shall fish in any river or fishery whatsoever within the said part of the said mannor of Totley and Dore aforesaid. From the Lord Middleton Collection, Nottingham University Collection.

As to ye pulling down ye walls at Totley was by Joseph White who did pull down ? of wall and he being a freeholder holds 6 acres of land under the Rt Hon Lord Middleton which was formerly inclosed from ye common and he only pays 4s per annum and awarding? As land is sett at Totley it is valued to be worth above £3 per annum.
Henry Dalton ** was another in pulling down the wall and he is tenant to my Lord and holds under him a smithy a hovel gardens and a lease of ye yearly value of 40s and only payes 8d per annum he did say Dam Lord Middleton Down with ye wall
Ralph Martin* he was another in pulling down ye wall and he holds half an acre of land belonging to ye Common at Totley at 4d per annum which is valued to be worth 7s per annum.
Edward Dalton was another who did pull down part of ye wall - and he hath enclosed from ye waste a house(or horse) poole and laid it to another ones land.
Christopher Newbould was another transgressor and did pull down part of ye wall, and hath enclosed a well and a fold from ye Lord's waste.
Robert Fisher was present at pulling down ye fence but did not pull down any part notwithstanding he raised ye riot and tumult to be made,
Ye quantity of land that was to be taken in was six acres and Mr Nodder and Mr Fenton assigned over the same to Christopher Elliott, there was about 15 roods of walling pulled down.(1210 square yards equals one rood)
Christopher Elliott tells me that he and Joshua Greene Sen. And Joshua Green Jun. Was present and did see ye wall put down and knows that what is above mentioned is true and is (un?)willing to sett their hands hereunder if my Lord take noe notice of this fact ye freeholders will enclose that all ye comons belonging to them.

Obviously there was ill will between two lots of villagers. On the one hand Elliott, Grisedale, Taylor, the Greens, versus White, the Daltons, Martin, Newbould and Fisher.

Letter to Lord Middleton.
Being a freeholder in the Liberty of Totley and finding dayley encroachment on said common give you the trouble of this because I presume my Lord Middleton and you have been wrongly informed as to the 8 or 6 ackers of land that Christopher Yellot (a gentleman of indifferent character) or his son in law one or both of them are for inclosing to the great prejudice of the freeholders as likewise the poor of the said liberty, he the same Yellot having some time ago inclosed a considerable close under pretence for a waife close*. He at same time hath it in tillage and for that which therefore inclosing hath as I'm informed advanced about foure pounds to the party that rent Coal Pitts of my Lord Middleton to gain an assignment from their lease which looks like buying and selling my Lords Comon. I hope Sir that you will please to consider that those tenants hath no power to sell or give the rights of the freeholders and this part of the comon lying so remote from said coal pitts. There is small colour (?) for its being inclosed on said account it likewise being the very best part and marrow of the common; and as I heare Mr White, Mr Offley and Mr Bagshaw so my self thinke it not faire to consent to it; I should have been proud to have waited of you would my indisposition given me leave for Sir I hope you'll excuse the trouble of this from Sir

About this time Derbyshire smelters who had a smeltery of this type in Bagillt, Flintshire, built a similar cupola at Old Hay, Totley. This extremely important site has been partly landscaped and the mill altered (it was used for scythegrinding in the 19th century and the outline of the dam can be traced and one waterwheel pit is visible). This is one of the earliest cupolas in Derbyshire – a process invented in Bristol about 1678., although it is quite likely that smelting took place at the Bole Hill in the Middle Ages. The humble petition of Sarah Webster of Totley in the County of Derby widow
Your Lordship’s tenant there for a cottage with appurtenances thereto belonging. That about 5 years ago your Petitioner was to wait upon Your Late Right Honorable Father and Your Lordship was present? At the same time concerning the tenant-right of the above mentioned cottage. And your Lordship’s Late Father ordered then that your petitioner should pay unto the ? who would have had her possession from her the sum of five pounds which she did at that time. And was obedient to your Lordship therein. And that after these five pounds were paid Your Lordship’s Father promised that your petitioner should have a confirmation made her of the said cottage upon the old rent and that your petitioner hopes that Your Lordship in your goodness may please to remember the same. And since that time your petitioner has laid out and expended upon the said farm in and about the same several considerable sums of money. But so it may please Your Lordship that Mr Whitehead Your Lordship’s steward hath advanced your petitioner’s rent from one shilling per annum into six shillings a year. And then made a further demand of two guineas which your petitioner paid unto the said Mr Whitehead, but upon what your petitioner knows not but paid the said Mr Whitehead the monies for fear that your petitioner should it oblige Your Lordship if she should refuse to pay the same and further your petitioner must of great necessity lay out a great deal more money upon a barn belonging to the said house which is now going to drop down by reason of the groundwork of the walls there being set upon the clay and not laid firm as they ought to have been.
This is followed by a note reading as follows:
Your petitioner most humbly begs that Your Lordship out of your tender compassion to a widow will out of your great goodness be pleased to give unto your petitioner a confirmation of the said cottage with the appurtenances upon the old rent according to your Late Most Honorable Father’s order that Mr Whitehead may not impose upon your petitioner any further and for Your Lordship’s long life and happiness as in duty bound will ever pray not

The Humble Petition of Robert Fisher of Totley Bents
Sheweth
Whereas your petitioner dwelleth in a cottage erected upon your Lordship's waste in ye Liberty of Totley which he and his ancestors have enjoyed time out of mind at ye yearly rent of eightpence a year, your Petitioner hath also another small cottage at ye yearly rent of fourpence , both which he hath enjoyed peaceably and quietly without any disturbance form your Lordship, or any of your noble ancestors, till of late one Mr Whitehead of Mansfield came and raised your petitioner to a very great degree notwithstanding he has a Deed to ye contrary which your Lordship hath seen and seemed to approve of and notwithstanding yet your Lordship Had given your petitioner a letter to deliver to ye said Mr Whitehead which he accordingly did; yet he forced ye petitioner to pay ten shillings, whereas his usual rent was but one, besides two guineas he had extorted from him before & ye like sum he took from several others besides ye advancement of ye rent and some of ye poore sort are raised to more than really they are able to pay. Now that what your petitioner humbly begs, is, that yr Lordship out of your great goodness would be pleased to take ye matter into consideration & reduce yr Petitioner rent to what it formerly was & order Mr Whitehead to pay him back the money which he so unjustly took from him

And also doth demise grant bargain sett and to farme lett unto the said Henry Thornhill his executors administrators and assigns all those his coal delfs or coal mynes and all pitts and veins of coal now open and known or that may be found out by digging or sinking on any part of the said Moor or waste ground which belong to the said Thomas Lord Middleton within the said Lordship (not making any pitt or holes within any of the orchards and gardens) with full and free liberty to and for him the said Henry Thornhill his executors administrators and assigns and his and their servants agents and workmen att any or times hereafter during the said term to dig delve…….?…..take carry away and dispose of all such coals as may or shall be got within the said…….?……. Grounds aforesaid he the said Henry Thornhill his executors administrators or assigns filling up the pitts or holes belonging to every of the said ….?… shall be opened during the said terme as soon as he has finished or ended each pitt together also with full and free liberty for him the said Henry Thornhill his executors administrators or assigns to burn coales into cowkes or cinders in some convenient place or places near the pitts together also with free liberty of all ways and free passages to and from the said coal pitts and to the three acres of land for himself his workmen servants and others with waynes waggons carthorses or other carriages whatsoever To Have and to Hold the said coales delfes coal mines pitts veines of coales three acres of land liberties and privileges unto the said Henry Thornhill his executors administrators and assigns for and during and untill the full end and term of one and twenty years from thence next ensuing fully to be compleat and ended yielding and paying yearly and every year during the remainder of the said terme of years which shall be then to come and unexpired in this present indenture unto the said Thomas Lord Middleton his heirs executors administrators or assigns the yearly rent of…………..of lawful money of Great Britain at two usual Feasts or Days in the Year (that is to say at the……. by even and equal portions ye first payment to be made at the……….which shall be in the Year of Our Lord One Thousand Seven Hundred and…………..In consideration whereof the said Henry Thornhill Doth for himself and for his heirs executors administrators and assigns and every of them Covenant promise and agree to and with the said Thomas Lord Middleton his heirs administrators and assigns and every of them by these presents in manner and form following (that is to say that he the said Henry Thornhill his executors adminstrators or assigns or some of them shall and will at their own cost and charges for the drawing and conveying away of the water from the said coal mine preserve the present sough in a perfect and sufficient manner and also shall keep a true level in the same so as to draw clear and convey away all the water out of the said coal mynes as aforesaid as far as he or his servants labourers or workmen shall digg and sink pitts or shafts and gett coal therein and also shall continue uphold and maintain the said sough and true level therein from time to time and at all times during the said terme of one and twenty years and at the end thereof shall leave the same so well and sufficiently upheld maintained and kept at the sight and judgement of two sufficient workmen to be employed by the said Thomas Lord Middleton his heirs or assigns in surveying viewing and ensuring of the same and the said Henry Thornhill doth further for himself and for his heirs executors administrators and assigns and every one of them covenant promise and agree to and with the said Thomas Lord Middleton his heirs executors administrators and assigns and every of them that he the said Henry Thornhill his executors administrators and assigns or some of them shall and will well and truly pay or cause to be paid unto the said Thomas Lord Middleton his heirs and assigns yearly and every year during the remainder of the said terme of one and twenty years the said yearly rent of pounds above reserved according to the true intent and meaning of these presents and also pay and discharge all levys taxes dutys assessments impositions and sums of money that shall be imposed taxed or assessed upon the said demised premises or any part thereof during the said terme or upon the said Thomas Lord Middleton his heirs executors administrators or assigns by reason thereof without any abatement forth of the said yearly rent and also that he the said Henry Thornhill his executors administrators or assigns shall and will gett and clear all the deep coales and bassett coal as..?..and not lose any level and shall keep and preserve the sough or level currant that the water ..? though the same and also ? ? ? Totley 250 years ago in 1746 Lord Middleton sold 4 acres of land at the Croft Head near Totley Bents to the Freeholders of Totley to help finance education of poor children in the district, the income from grazing the land would provide revenue. Down at OldHay or Olda Cupola George Barker smelted lead brought over from Derbyshire by pack horse. That same year widow Anne Greaves of Totley Bents made her Will. Her Inventory reflects the modest wealth of this well-established Totley Bents family who farmed in a small way and at one time leased the local coal mine and also smelted lead nearby. She left 9 couples of ewes and lambs, 22 gelt sheep, 3 milk cows, 2 calves, an old cow and 3 stirks (young bullocks or heifers), certain goods and chattels. There were obviously many household effects, beds, chests, chairs, bed-linen, pillows, pots and pans and so on even including rare pieces for this area - a desk and 2 virginals. The complete list and values are to be found in the Wills and Inventories at Lichfield Joint Record Office although thankfully photocopies can be studied at Sheffield Archives Dept. Dore Village Society published a selection of Dore and Totley Wills and Inventories between 1539 and 1747 in a booklet entitled 'Seke in Body, Hole in Mynd' available from local shops. The publication provides an interesting background to local life in the 16th, 17th and 18th centuries.

Totley Cupola on the road from the lead mining areas in the High Peak to navigable water on the Don and well sited for coal supplies from the nearby Alton seam, was leased by George and John Barker. In addition to smelting ore at Shacklow the brothers had leased other smelting mills at Rowsley & Beeley....
...the fact that the cupola could smelt grades of ore impracticable in the smelting mills led to the Barkers buying ore discarded by previous generations of miners from Winster and Matlock. The lead smelted at Totley was sent by road to Rotherham the then head of navigation on the river Don and from there down river to Thorne where the greater part was bought by Milnes and Wilkinson (see cash account book J & G Barker 1743 - 51

April Robert Pinder of Totley was granted licence as common swailer at Chesterfield quarter sessions. There seems to have been some distinction between swailers and badgers from 1552 - 1772. These types of small traders as well as drovers had to be licenced. The name badger was derived from the 1697 Settlement Act whereby paupers were obliged to wear a capital P on their clothing. The term was later used loosely for pedlars and chapmen.
In Jan 1748 Wm Totley of Dore was listed as a swailer - 'who was he? Could he have been William Dalton?'
Only in 1748 and 1751 were there licenced swailers from Totley and then the same man, Pinder. See List of Badgers and Swailers - most of whom are Dore and Dronfield. Only above 2 are Totley

Following on from the 1720 gift of Rev Robert Turie of whose legacy one third being £13.6s.8d. was paid for inclosing a piece of land on Totley Common. By indentures of lease and release bearing date 10 & 11 October 1753 (or 1752?) between Francis Lord Middleton, Lord of the Manor of Totley, of the first part and Edmund Offley and five others of the other part, reciting that the said Offley and others were principal freeholders or inhabitants within the said manor; and being desirous of erecting a schoolhouse and making a provision for the teaching of such children as thereinafter mentioned, had applied to the said Lord Middleton granted to the said Offley and others, and their heirs, a piece of ground, commonly called the Croft Heads, being part of the waste belonging to the Manor of Totley, containing by estimation 4 acres, in trust, for erecting a school or school house upon the same, and to receive all the rents and profits of such a school or schoolhouse, and of the premises thereby granted, and to apply the same for the teaching of English, and in the Church Catechism, six poor children, boys or girls, of and belonging to the Liberty of Totley, such as the said trustees for the time being should think proper to nominate for that purpose; and it was provided, that the said Lord Middleton, and his heirs, should be always trustees, and whenever two only of the othertrustees should be living, the survivors should appoint other freeholders of the said Manor and convey the premises to the use of themselves and such new trustees, and Lord Middleton and his heirs.

By indentures of lease and release, dated 10 and 11 October 1753 Lord Middleton gave land for a school but this was enclosed and the rent used to support six Totley children at Dore School. "By indentures a piece of waste land about 4 acres was conveyed to trustees * in order that a school might be erected upon it, the intention was never carried into effect and the land is let for £6 p.a. which is paid for the instruction of 6 poor children. Some time ago inhabitants proposed to build a school by subscription. The plan was however abandoned and a school built by D'Ewes Coke on his own land. A sum of £125 was raised towards building the school and was put out to interest for the use of the schoolmaster. See details of the school on Totley Hall Lane

See 1748 card….. on the death of George Barker the business was managed by his brother Alexander . As well as working Shacklow Mill, Barker operated another of the old type of smelting mills at Calver on the Derwent. Much more important from the production angle was his possession of Totley Cupola, where he installed more furnaces in 1757….Totley.Cupola. was supplied by purchasing the share of the ore from Odin Mine Castleton owned by Messrs Smallcross and Redcliffe, and by purchase of ore from Little Pasture, Miners' Engine and Consolidated Titles Mines on Eyam Edge.

There is a schedule of papers reference the Verdicts of the Jury at the Courts Baron of the Right Hon. Lord Middleton held for the Honour of Peverell at Totley and other places in the County of Derby relating to the period 20 October 1702 to 11 May 1763. There are also 8 Suit Rolls containing the names of all freeholders and copyholders and 7 rentals of the cottages and intakes. BE has seen and has copies of most of these documents some of which are not dated and are in a separate file marked TOTLEY COURTS BARON AND LEET, 1561 – 1786 Ring binder. Unfortunately the information therein can be rather sparse. However the rentals are more interesting and contain names and sometimes trades and clues as to individual houses and then it shows the old and new rents. The rentals for 1762 indicate that there were about 24 houses in total say 90 – 120 people.

Case regarding several small rents payable to the Right Honourable Lord Middleton for estates within the Manor of Totley: My Lord Middleton is Lord of the Manor of Totley and there have been Courts held there under the Honour of Peveril for upwards of 60 years as appears by the verdicts. There are many small rents payable to His Lordship some of which are not a tenth part of the value of the premises for which they are paid.
It is apprehended these small rents originally arose from acknowledgements that were paid to the Lord for his consent to take inclosures of the common and that when the freeholders there agreed to permit any person to inclose such person applied to the Lord's steward for his consent who gave it upon their agreeing to pay such acknowledgment which was entered in the rental and collected by the Steward when he held the courts. By a rental dated about 1736 which is the first we can find there are three columns entitled old rents, rents as raised and received by Mr Whitehead, and rents as reduced and settled 28 October 1736 which all of them differ and if the payment of those three different sums could be made out by any accounts wherein Mr Whitehead or any of the stewards had given credit for them it might be very useful but His Lordship does not find any accounts so far back and there has never been any variation of these rents since the year 1736 as appears by the rentals and the late Mr Gardiner's accounts. His Lordship now thinks it proper that these rents should be raised a reasonable way for they have long been enjoyed for such small acknowledgements as have not half paid the expenses of the courts: But is first desirous of knowing whether an ejectment can be maintained against the tenants of his Lordship in case of their refusal to pay an advance rent and rendering the old ones.
As no acknowledgement has been paid by any of these tenants to any person for the Freeholders who had also originally a right to insist upon the same. It is apprehended the Freeholders can now have no pretence of claim whatsoever and therefore your opinion is desired whether these rents paid in manner aforesaid without variation for 28 years last past can give such tenants a freehold subject to the payment of such rents. Several of the tenants are Freeholders and therefore you will please also to consider whether such tenants who have on that account right of common can in law be supposed still to have preserved such right upon their respective Takes as will now impower them to pull them down if they are determined not to pay such rent as His Lordship expects. For although the rest of the Freeholders are precluded by time from pulling down, yet if each respective tenant who is a Freeholder can justify this doing so upon his own respective take this may be equally injurious to His Lordship and in such case it seems most eligible for His Lordship to grant short leases at a very trifling advance which probably would be accepted of and by all the tenants and then at the expiration of such leases His Lordship's title would be indisputable.

Reply by Edward Wilmot on 6th August 1764 to the above letter is as follows:
The question arising upon the above case has been long litigated thereon and great variety of opinion has been upon it and that same is still a vexatious question but if it can be made to appear that such freeholders took in such inclosures from the waste with the privity and by the consent of the then Lord of the Manor upon agreement to pay such reserved (?) rent by way of acknowledgement to the Lord for his license to take in such inclosures I then think that Lord Middleton in such case may maintain such ejectment; but if such inclosures were made up and taken in from the comon without any lease or license applied for to or granted by the then Lord, and an adverse possession has since been continued, I then apprehend that such length of an adverse possession will give such a legal title to the freeholders to such inclosures paying such acknowledgements or reserved rent that Lord Middleton will not be able to maintain an ejectment; and I have generally observed that the judges upon the tryall of such titles have greatly inclined in favour of such titles, where such payments of a certain small sum have been yearly paid for a number of years: and I don’t know by what right a Lord of a Manor or any other person can refrain(?) the several tenants or freeholders in the possession of the several inclosures taken from the common, from prostrating the fences and laying the same again open to the common, when the rest of the freeholders will then be at liberty to retain there antient right of common, although they were barred by the length of time the same were so inclosed, from pulling down the fences and laying the same open to the common, and therefore I think that if the several freeholders will take leases (which I scares think they will) that it will be most advisable for Lord Middleton to grant them such leases, for at the end of such leases His Lordship may then maintain an ejectment against them and such leases will I think be an Estoppel at Law to such freeholders from setting up a title in themselves to such premises (?) so leased.

By the intercession of your Brother Mr Francis Willoughby I obtained from the late Lord Middleton a Deputation of Gamekeeper for the Manor of Totley in Derbyshire lying about seven miles from Sheffield for Thomas Dalton, yeoman, who lives there & was recommended by some gentlemen in the neighbourhood as an honest careful man and no game killer. By his care a few broods of moor game have been to be met with for two or three years last upon the Moors, where before that time scarce one was to be seen, & they have afforded two or three days diversion in the shooting season to myself and one or two other Gentlemen in the Neighbourhood & other gentlemen, who have accidentally passed that way on shooting parties, and the Poachers have in a good measure been kept off. If Your Lordship will be so kind as to renew the Appointment of Thomas Dalton for the same purpose, I shall esteem it as a great favour; & as the shooting season approaches it will be very convenient to have an authorised gamekeeper there as soon as possible. I shall upon that account hope Your Lordship will please to give him the Deputation as soon as the Instrument can be prepared for signing. And if Your Lordship will honour me with a favourable answer directed to me at Sheffield I will take care to have it laid before you properly drawn by Mr Manley of Chesterfield if he be the steward of the Manor as he was in the late Lord’s lifetime I hope to be at Home before this day week. The melancholy occasion of my brother John’s death has now drawn me hither and prevented me from making this application to Your Lordship sooner. About two months ago I called at your door in Portman Square in hopes of having the honour of seeing Your Lordship & congratulating you on your Accession to the High Honours of the Family Title & Estate, the Intelligence of which had given me sincere Pleasure. Mr Frank Willoughby called upon me in his way to Buxton & then seemed better in health tho’ not without complaints, than when I had seen him the last time before that. Wm Manley of Chesterfield wrote to Lord Middleton saying that the freeholders of Totley 'wish an inclosure of the Commons’ (BE copy) ‘My Lord At the request of Mr Wilkinson I send the enclosed deputation which he desires the favour of your Lordship to execute and return to me. The freeholders of Totley wish an inclosure of the Commons within that Manor which was thought of some time ago when the late Lord Middleton was applied to regarding it, there are some disputes as to the boundaries which should be settled whether the inclosure is approved of or not and I hope that business may be done amicably as I have applied to the agents of the Dukes of Rutland and Devonshire for that purpose. I believe I shall be requested by the freeholders to wait upon your Lordship regarding these matters in the course of the summer and I will endeavour to get the necessary information in the interim. I am my Lord your Lordship’s most obedient and faithful humble servant. William Manley’
23 June reply ‘I desire you will make yourself acquainted how part of and in what manner my interest would be affected by an inclosure of Totley and shall be obliged to you for your thoughts and reply by letter at your leisure on that subject. William Green devised to William Green the son of his nephew Thomas Green and his heirs, his freehold houses or tenements, gardens and croft, situate in Totley, charged with the payment of 12s per year which he directed should be laid out by 12d each calendar month in bread, the same to be distributed by his executor, and his heirs, the fourth Sunday in every such month in the Chapel of Dore to such poor persons as they should judge proper objects of charity; and for want of such heirs, he empowered the chapel wardens for the time being to receive the said annuity and distribute the said bread. The above mentioned premises are now the property of William Green, and he distributes one shillings worth of bread on every 4th Sunday at Dore Chapel amongst poor persons of Totley, as the gift of the said testator.
A board in old Dore Infant School (back corridor) reads: ‘ William Green of Totley gives the sum of 12 shillings to be paid yearly for ever to the poor out of the rents and profits arising from certain lands and tenements in the Township of Totley. This money to be paid by the nephew of the said William Green and at the decease of the said nephew to be vested in the hands of the chapel warden of Dore for the time being for ever for the above purpose.’

( three daughters) . The sum of ten pounds apiece the which said use intent and purpose (sic)
To my said daughter Ann Ross or to her three eldest children I shall refer the direction and approbation of my eldest son John Mitchell of Totley aforesaid. His executors or administrators and ? said John Mitchell his executors or administrators think proper to appoint my said daughter Ann Ross's three children to have the sum of ten pounds apiece instead of her having the sum of thirty pounds and if any of these die before attaining the age of 21 years or marriage as aforesaid I give and bequeath the share of that so dying to the survivors each an equal share and if more than one die before they attain the age of marriage as aforesaid I give and bequeath the whole of the said several sums to the survivors
Also I will and ordain that the aforesaid legacies shall be paid to the several aforesaid legators respectively at their respective age of 21 years or days of marriage which shall first happen all the residue and remainder of my personal estate goods and chattells And disposed of after payments of any debts legacies and funeral expenses and charges of proving this my will I give and bequeath unto my said son John Mitchell to and for his own use and benefit and I do appoint him sole executor of this my last will and testament hereby revoking all former wills by me made in witness whereof I the said Jonathan Mitchell the testator have to this my last will and testament set my hand and seal the date and year first written above.

1st December John Carter the High Constable wrote to the Constable and Head Boroughs of the Parish of Dore and Totley in the Hundred of Scarsdale in order to establish the crops grown ‘By virtue of a warrant from two of His Majesty’s Justices of the Peace acting in the said County and Hundred aforesaid, to me directed, you are hereby required immediately on sight hereof, to collect and take a true account of the numbers of acres of the several kinds of grain that have been grown within your parish in the year 1795, comparing the same with the produce of a fair crop of every such article of grain in common years, and particularly with the produce of the year 1794, of every such article of grain; which accounts you are hereby required to deliver unto me at the house of Mr John Deakin, the Falcon Inn, in Chesterfield, on the 19th day of December instant. Herein fail not at your Peril’
